Water Regulations 2008 - commenced 30th June 2008

The Bureau of Meteorology's new water information functions are described in the Commonwealth Water Act 2007 under Part 7 - Water Information. These new functions are supported by the Water Regulations 2008.

Farmland near CairnsIntroduction

Under the Commonwealth Water Act 2007, the Bureau of Meteorology (the Bureau) is tasked with a range of functions which require it to collect, hold, manage, interpret and disseminate Australia's water information. Section 126 of the Act provides for the making of Regulations to support these functions.

The Water Regulations 2008 specify who must give specified water information to the Bureau and the time and format in which they must give it.

The Regulations came into effect on 30 June 2008.

About the Regulations

Who has to give water information?

The term 'persons' is used in the Regulations to refer to both private and public entities. It includes individuals as well as trusts, companies, corporations and agencies of State, Territory or Commonwealth Governments that are required to give water information to the Bureau.

Persons named in the Regulations are grouped into eight categories; Categories A to H. The categories are based on functions. Persons may be in more than just one category as they may perform more than one function.

The Regulations individually name 260 persons who are required to give the Bureau specified water information that is in their possession, custody or control.

Where to from now?

We are working with persons named in the Regulations to ensure they are fully aware of what they must do and assisting them to comply with the Regulations. We are initially focussing on those persons in Categories A, B and C who are required to give information by the 1st of October 2008.

In the meantime, named persons are encouraged to become familiar with the requirements placed on them by the Regulations. You can do this by using our 'Water Regulations Online' tool to generate a customised report that lists your organisation's obligations.
